Required Information:

• Brief statement of claim
• Amount of claim
• Filing Fee – Maximum of $15.00 (No personal checks)

Incorporated Businesses, Individuals who cannot file in Small Claims Actions

Civil Suit Actions:

• Summons & Complaint prepared, signed by either an attorney, or the Court Clerk
• Summons must be served at least six (6), but not more than thirty (30) days before hearing date
• A copy of summons & complaint with affidavit of service attached, shall be filed with the court within six (6) days of service
• Filing Fee – $20.00 (No personal checks)

Summary Proceedings (Evictions)

Forms Needed:

• Notice of Petition
• Petition to Recover Possession of Real Property
• Applicable Notice to Vacate & Affidavit of Service of same, applicable warrant if seeking removal

WHAT IS NEEDED TO FILE

• Have Notice of Petition & Petition to Recover Possession of Real Property filled out
• Have Applicable Notice to Vacate & Affidavit of Service of same with petitions
• Make sure Respondent (Tenant) is served not more than seventeen (17) days or less than ten (10) days before hearing date
• Make sure Notice of Petition & an Affidavit of Service is filed with the court within three (3) days of service
